Terms of Service

1. Acceptance of Terms
By accessing or using Radhiant CDS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. The Service is provided by Radhiant (Pty) Ltd ("Radhiant", "we", "us", or "our").
2. Description of Service
Radhiant CDS is a clinical decision support tool that provides evidence-based appropriateness guidance for diagnostic imaging requests. The Service is designed to assist healthcare professionals in making informed imaging decisions and is not intended to replace clinical judgement.
3. Clinical Disclaimer
The Service is for clinical decision support only and does not constitute medical advice. All imaging recommendations are based on published guidelines and should be interpreted in the context of each individual patient's clinical presentation. The treating clinician retains full responsibility for all clinical decisions. Radhiant does not accept liability for clinical outcomes resulting from the use of this tool.
4. User Accounts
You must create an account to access the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be a registered healthcare professional or healthcare student to use the Service. You agree to provide accurate and complete registration information.
5. Subscription & Payments
Access to the Service requires a paid subscription. Subscription plans and pricing are displayed on the billing page. Payments are processed securely through Stripe. Subscriptions renew automatically each month unless cancelled. You may cancel your subscription at any time through the billing portal; access will continue until the end of the current billing period. Refunds are handled on a case-by-case basis at our discretion.
6. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to the Service or its systems; (c) share your account credentials with others; (d) use the Service to provide direct patient care without appropriate clinical oversight; (e) reverse-engineer, decompile, or disassemble any part of the Service; (f) use automated tools to scrape or extract data from the Service.
7. Intellectual Property
All content, algorithms, clinical pathways, and software comprising the Service are the intellectual property of Radhiant or its licensors. The clinical guidelines referenced within the Service remain the property of their respective publishers (ACR, ESR, RCR, etc.). You may not reproduce, distribute, or create derivative works from the Service without prior written consent.
8. API Access
Pro subscribers may access the Service via REST API for integration with electronic health record (EHR) systems. API access is subject to rate limits and must be used in accordance with the API documentation. API keys are confidential and must not be shared or exposed in client-side code.
9. Limitation of Liability
To the maximum extent permitted by law, Radhiant shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or clinical outcomes, arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.
10. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
12. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, and governing law shall survive termination.
